Federal Hacking Laws – Some Pointers

We wanted to close out this series by pulling together some information for clients on the federal laws (US) surrounding computer intrusion and hacking. Here are some pointers for your consideration:

Internet crime is among the newest and most constantly evolving areas of American law. Although the Internet itself is more than three decades old, greater public usage began in the late 1980s with widespread adoption only following in the 1990s. During that decade the Net was transformed from its modest military and academic roots into a global economic tool, used daily by over 100 million Americans and generating upwards of $100 billion in domestic revenue annually. But as many aspects of business, social, political, and cultural life moved online, so did crime, creating new challenges for lawmakers and law enforcement. 

Crime on the Net takes both old and new forms. The medium has facilitated such traditional offenses as fraud and child pornography. But it has also given rise to unique technological crimes, such as electronic intrusion in the form of hacking and computer viruses. High-speed Internet accounts helped fuel a proliferation of copyright infringement in software, music, and movie piracy. National security is also threatened by the Internet’s potential usefulness for terrorism. Taken together, these crimes have earned a new name: when FBI Director Louis J. Freeh addressed the U.S. Senate in 2000, he used the widely-accepted term “cybercrime.

Great explanation (dated though – 2006) of Section 18 of the US code and their relevant sections to cybercrime.

The main hacking laws are in the US Computer Fraud and Abuse Act passed in 1986 and has undergone several amendments. 


Based on the history of hacking, computer problems caused as a result of hacking were continuously increasing and like recent times ethical hacking became unpopular because of the notoriety of black hats. What do you think? If these laws weren’t there, ha! Imagine what would have been happening. I like the efforts of the US government on hacking. 

Hacking laws according to the US laws(Computer Fraud and Abuse Act) states, 

Hacking Law 1 

1.Whoever having knowingly accessed a computer without authorization or exceeding authorized access, and by means of such conduct having obtained information that has been determined by the United States Government pursuant to an Executive order or statute to require protection against unauthorized disclosure for reasons of national defense or foreign relations, or any restricted data, as defined in paragraph y of section 11 of the Atomic Energy Act of 1954, with reason to believe that such information so obtained could be used to the injury of the United States, or to the advantage of any foreign nation, willfully communicates, delivers, transmits, or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it;

2.Intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains– 

Information contained in a financial record of a financial institution, or of a card issuer as defined in section 1602(n) of title 15, or contained in a file of a consumer reporting agency on a consumer, as such terms are defined in the Fair Credit Reporting Act (15 U.S.C. 1681 et seq.); 

B.Information from any department or agency of the United States; or 

C. Information from any protected computer if the conduct involved an interstate or foreign communication;

3. Intentionally, without authorization to access any nonpublic computer of a department or agency of the United States, accesses such a computer of that department or agency that is exclusively for the use of the Government of the United States or, in the case of a computer not exclusively for such use, is used by or for the Government of the United States and such conduct affects that use by or for the Government of the United States;

4 Knowingly and with intent to defraud, accesses a protected computer without authorization, or exceeds authorized access, and by means of such conduct furthers the intended fraud and obtains anything of value, unless the object of the fraud and the thing obtained consists only of the use of the computer and the value of such use is not more than $5,000 in any 1-year period; 

A.Knowingly causes the transmission of a program, information, code, or command, and as a result of such conduct, intentionally causes damage without authorization, to a protected computer; 

B. Intentionally accesses a protected computer without authorization, and as a result of such conduct, recklessly causes damage; or 

C. Intentionally accesses a protected computer without authorization, and as a result of such conduct, causes damage;

Reporting Cyber-Crimes:

Every day, criminals are invading countless homes and offices across the nation—not by breaking down windows and doors, but by breaking into laptops, personal computers, and wireless devices via hacks and bits of malicious code. 

The collective impact is staggering. Billions of dollars are lost every year repairing systems hit by such attacks. Some take down vital systems, disrupting and sometimes disabling the work of hospitals, banks, and 9-1-1 services around the country. 

Who is behind such attacks? It runs the gamut—from computer geeks looking for bragging rights…to businesses trying to gain an upper hand in the marketplace by hacking competitor websites, from rings of criminals wanting to steal your personal information and sell it on black markets…to spies and terrorists looking to rob our nation of vital information or launch cyber strikes. 

Today, these computer intrusion cases—counterterrorism, counterintelligence, and criminal—are the paramount priorities of our cyber program because of their potential relationship to national security. 

Combating the threat. In recent years, we’ve built a whole new set of technological and investigative capabilities and partnerships—so we’re as comfortable chasing outlaws in cyberspace as we are down back alleys and across continents. That includes: 

A Cyber Division at FBI Headquarters “to address cyber crime in a coordinated and cohesive manner”; 

Specially trained cyber squads at FBI headquarters and in each of our 56 field offices, staffed with “agents and analysts who protect against investigate computer intrusions, theft of intellectual property and personal information, child pornography and exploitation, and online fraud”; 

New Cyber Action Teams that “travel around the world on a moment’s notice to assist in computer intrusion cases” and that “gather vital intelligence that helps us identify the cyber crimes that are most dangerous to our national security and to our economy;” 

Our 93 Computer Crimes Task Forces nationwide that “combine state-of-the-art technology and the resources of our federal, state, and local counterparts”; 

A growing partnership with other federal agencies, including the Department of Defense, the Department of Homeland Security, and others—which share similar concerns and resolve in combating cyber crime.

How to Report Computer Hackers 

Many computer users fall prey to hackers and the crimes they perpetrate on unsuspecting individuals and companies. If a crime occurs in your home or business, it’s not difficult to report the computer hacker. 

Determine which agency has jurisdiction over the crime. This will depend upon whether the crime was committed at your home or at your business, and the address of that particular location. If you live within city limits, the proper agency will generally be a police department in your town. If you live outside the city limits, within the county, contact your local sheriff’s office. 

Call the non-emergency phone number for your local police department or sheriff’s office to report the crime. Ask to speak with someone in the detective’s division about an Internet crime.

Reporting Computer Hacking, Fraud and Other Internet-Related Crime 

The primary federal law enforcement agencies that investigate domestic crime on the Internet include: the Federal Bureau of Investigation (FBI), the United States Secret Service, the United States Immigration and Customs Enforcement (ICE) , the United States Postal Inspection Service, and the Bureau of Alcohol, Tobacco and Firearms (ATF) . Each of these agencies has offices conveniently located in every state to which crimes may be reported. Contact information regarding these local offices may be found in local telephone directories. In general, federal crime may be reported to the local office of an appropriate law enforcement agency by a telephone call and by requesting the “Duty Complaint Agent.” 
Each law enforcement agency also has a headquarters (HQ) in Washington, D.C., which has agents who specialize in particular areas. For example, the FBI and the U.S. Secret Service both have headquarters-based specialists in computer intrusion (i.e., computer hacker) cases.

Great explanation of Tor in Less than 2 Minutes

Child Pornography Resource Materials for Businesses

Sadly, as an information security professional, we are sometimes engaged with clients who either suspect or have discovered the presence of child pornography in their computing environment. Another way that such materials come to our attention, is during pen-testing or incident response work, we may discover the materials on a system and be forced to bring the materials to the attention of law enforcement.

In many cases, clients ask us why we are required to notify law enforcement, and/or why they are required to notify law enforcement about this material. Perhaps your organization has struggled with this in the past. In any case, we hope the following information helps organizations understand the US legal requirements for handling such materials. (If you live outside of the US, please consult local legal assistance for your laws and procedures.)(NOTE: MSI is not providing legal advice of any kind, consult your attorney or council for legal advice. This material is simply meant to be a pointer for education. MSI is NOT qualified to offer legal advice under any circumstance.)

The Department of Justice lists the following federal statutes for online child pornography:

  • 18 U.S.C. § 2251- Sexual Exploitation of Children (Production of child pornography)
  • 18 U.S.C. § 2251A- Selling and Buying of Children
  • 18 U.S.C. § 2252- Certain activities relating to material involving the sexual exploitation of minors(Possession, distribution and receipt of child pornography)
  • 18 U.S.C. § 2252A- certain activities relating to material constituting or containing child pornography
  • 18 U.S.C. § 2256- Definitions
  • 18 U.S.C. § 2258A- Reporting requirements of electronic communication service providers and remote computing service providers
  • 18 U.S.C. § 2260- Production of sexually explicit depictions of a minor for importation into the United States

A summary of these laws is that it is the federal law that mandates this duty to report specifically requires that “electronic communication service providers” report child pornography. (18 USC § 2258A. Reporting requirements of electronic communication service providers and remote computing service providers.) An “electronic communications service” means “any service which provides to users the ability to send or receive wire or electronic communications.” The term “electronic communication,” for purposes of the reporting requirement, means “any transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic, photoelectronic or photooptical system that affects interstate or foreign commerce.” All of which is to say that both the business/employer that provides the computer or phone system over which the data is communicated, as well as the IT company that helps the employer maintain those systems, are covered by this law. A business or IT service company ignores child porn at its peril. Failing to report the information to the National Center for Missing and Exploited Children violates the Section 2258A reporting requirements. Deleting the material might make the company an accessory to the underlying crime of possessing the information in the first place. Making copies of the material and then transmitting the copies, except at the direction of law enforcement officials or as required by section 2258A, also runs afoul of the laws proscribing possession of child pornography. A first violation of Section 2258A carries a penalty of up to a $150,000 fine. A second violation can be penalized by up to $300,000.

According to the Department of Justice website, to report an incident involving the production, possession, distribution, or receipt of child pornography, file a report on the National Center for Missing & Exploited Children (NCMEC)’s website or call 1-800-843-5678. Your report will be forwarded to a law enforcement agency for investigation and action as detailed here.

It may be required or optional to report to local law enforcement as well, and is dependent on state and local laws and statutes.

According to the National Conference of State Legislatures website, the state of Ohio does not have explicit state policies requiring businesses to report the incident, as detailed here (as of Sept 2013), though again, local statutes may vary by location.

We also found this article, which might be helpful in understanding risks from a legal perspective for businesses who might find child pornography on their server, as it lays out a process for organizations to follow.

Always Remember the Business, InfoSec Folks

I just got out of yet another meeting with a big company partner for whom we act as an information security and threat advisor. In that meeting, I listened to a keyed-up,  hypercaffinated group of good guy security geeks tell their senior executives about the latest set of DLP controls they were putting in place. They spent 45 minutes describing packet-level checking, data flows, architecture diagrams and the technology of their solution set in painful (even for me) detail. Many of the executives were dosing lightly, while the geeks spun their techno-web. That’s when things took a turn for the worse…

The COO asked them one single question, interrupting a slide about email data flows ~ “How will this impact the business of ‘Dan’s’ group and the ‘Singularity’ project we have been working on since 2011? Doesn’t it depend on some of that data?” (**Names changed to protect the innocent and the guilty…)

Then, NOTHING HAPPENED. You could have heard a pin drop. Dead silence for close to two minutes. Finally, the COO repeated the question. Still nothing. He asked the lead geek if he knew who Dan was, and the geek said yes. He asked if Dan had been interviewed by the geeks prior to this. They said, no. The COO erupted in a rage, railing about how Singularity was the largest new line of business launch in the history of the company and how the projected income from the business would change the landscape of the firm. There were a LOT of apologies and some amount of notes taken to immediately consult with Dan. Much geek cred was lost. It will be a while before they get to present to the executives again like that. 

I tell you this story simply to remind all infosec folks about something I see all too often. It’s about the business. We are about the business. We are there to secure the business, nurture it, protect it, empower it to succeed. If that’s not where you or your team are, then you are doing it wrong. Get it right. Talk to the business. Speak their language. Give up on the “beauty of the baud” approach. Your packets and technology stack may be gorgeous to you, but if they don’t align with the business, then they won’t do anyone, including you, any good at all. Keep that in mind at all times. Also, remember to always talk to Dan ~ he’s a nice guy and he appreciates it. He can give you the answers you need and usually, he desperately wants to understand what you can do to make his project a success. Get to know all the Dan’s in your organization. They drive the world, you support them, together you build business and all of you will succeed!

Q: “I’m a one man infosec team at a small financial company, and as such, I stay overtasked. Can you give me a few examples of some key tasks I should make sure I am doing daily/weekly/monthly to make sure I am hitting them all and to help me better structure my schedule?”

Bill Hagestad answered with:

Daily Tasks: 

– Keep self and staff educated about latest cyber threats to your business – read the MSI Blog @ State of Securityhttps://stateofsecurity.com/;
– Review what Federal Law Enforcement considers top cyber threats are base on current cases:
– Compromise of account holder credentials leading to legitimate account compromise;
-Via  phasing attack vectors; unauthorized ACH transfers; 
– Compromise of Third Party Payment Processors;

Adam Hostetler added:
It’s hard to answer exactly what you should be doing on a timely basis
without reviewing your current requirements, tools, processes, and
infrastructure. However, If you go to www.microsolved.com and look at
our 80/20 white paper, you can use that as a guideline to give you some
ideas to help build out your security program.

Examples of some things you could/should be doing.

Daily:
Log reviews. Not necessary for all logs, but if you have
IDS/IPS/Honeypots etc, they should be reviewed and investigated if needed
Spend a bit of time following up on the latest security news/threats.
That includes things like new vulnerabilities or exploits, and then
following up if it would affect you.

Weekly:
Check and verify backups and processes

Monthly:
Update software/OS patches.

 
Finally, Jim Klun weighed in with: 
1. Make sure your subscribed to security news-feeds/alerting services that apply to your environment. Review those daily.

2. Make sure you are reviewing your logs daily.  You should know every day about successful and unsuccessful logins. You should also be paying attention to your firewall logs for inbound activity and outbound activity.

3 If you have a local help desk, talk to them at least monthly. They are often in a position to see things that are in fact security problems.

4. Automate your patching program if that is not true already, then review patch reports monthly.

5. If you have Internet exposures, check them monthly. Make absolutely sure at the end of each month you are absolutely sure of what services your organization offers to the Internet – and why.

Average Knowledge Worker & Infosec

Last week, I had the chance to interview someone I would consider to be an average knowledge worker. They work in the area of being a virtual personal assistant, often using the Internet and their computer to serve the needs of their clients. They were chosen at random from a pool of VPAs. Here’s the short interview I did with them:

Q. What types of information security threats concern you most as a person who is dependent on their computer to earn a living?

A: I am most concerned about the potential for my getting “hacked” to impact clients or colleagues. I would hate to be the “weakest link” in the chain of information, and therefore take information security very seriously.

Q. What types of security tools do you use to protect the systems that belong to your family (firewalls, anti-virus, anti-malware, etc.)

A. I have my home network secured and encrypted, installed McAfee’s anti-virus app on all computers in the household network, and have taught my oldest son, who uses it via his laptop, to ALWAYS ask if he’s in doubt about clicking a link or approving an update. I’d rather he pester me every time Windows wants to update itself than potentially put our network at risk!

Q. How much does information security impact your life on the Internet? (Do you bank, shop, vote, trade, etc. online?)

A.  I bank and shop online, and honestly I mostly just try not to think about it. I take every reasonable precaution and don’t want to let fear influence my decision-making beyond that. 

My takeaways from the interview were actually good news. The basics of having a network firewall, doing some basic wireless security and installing some basic AV on machines has clearly entered the mainstream of the computing culture. That’s the good news. Sadly though, it would seem, I would guess that the controls stop there. I was glad to see that knowledge workers are training their children in the basics as well. I remember when just those steps were quite a leap. 

I was also kind of sad that the person said they try not thing think about the security risks. I wish they had said something along the lines of “I try and make rational security decisions to still enjoy modern online conveniences while allowing a modicum of safety.” or something like that. Sigh, I guess we still have some work to do. 🙂

Ask The Security Experts: Public Facing Workstations

This time around, we have a question from a reader named John: “I work in a small financial institution and we have problems with physical access to our computers. Many of our workstations sit in semi-public areas and could easily be attacked with USB devices or physical access when a teller or customer service person leaves the customers alone with the machine at a desk or cubicle. What advice do the experts have to help counter these types of attacks?”

Bill Hagestad started the conversation:

Recommended Points for mitigating this digital & physical vulnerability;

1) Remove workstations from semi-public areas; 2) Deploy & install single – purpose Internet workstations at no more than 2 public locations with VERY limited access to financial institution records only after 3 factor authentication has been authorized by credentialed users only; 3) Set time limites on inactive sessions on all banking terminals to logoff after physical proximity to machine exceeds 15 seconds; 4) Enforce 32 random, alpha-numeric character password changes to all critical financial institutional systems weekly; and, 5) Implement and /or continue aggressive financial institution information assurance education program with goal of 100% employee participation; review/update monthly and, 6) Mandate information security and awareness program participation from financial institution leadership throughout all employees and ranks within the organization.

John Davis expanded: I know how difficult this is for financial institutions. Your customer service representatives need computers in their cubicles in order to provide service to your customers, while at the same time those same computers are a main point of physical vulnerabilitiy. Easy steps can be taken, though, to harden these work stations.

First, workstation users should be allotted local administration rights on their systems only when a business need is present. So, CSR workstations should have their USB and DVD ports disabled. Furthermore, their is no need for them to have the ability to upload or download software. In addition, workstations in publicly accessible areas must be turned off each and every time they are unattended. Perhaps you could implement a system similar to the cut off device used on treadmills or at casinos: CSRs would have to clip a device from their clothing to the workstation before it will work. You could accompany this with biometric access for quick and easy access for the users.

Jim Klun added:

From my experience, and assuming the worst case of Windows systems configured as normal workstations with end-users having admin level access, some immediate things I would do:

1. Disable all removable media access at the hardware ( i.e. BIOS) level. At minimum: disable ability to boot from such sources. or: remove all DVD and CDROM drives and physically disable USB ports. (e.g. glue) 2. Ensure all workstations log activity and ensure that the logs are directed to a central log repository and reviewed. Example: http://www.intersectalliance.com/projects/SnareWindows/ 3. Ensure surveillance cameras cover workstation areas. 4. Aggressive screen-lock settings 5. Removal of admin access for all but limited support staff if at all possible. 6. Consider Usage of security cabinets for workstations: Example: http://www.globalindustrial.com/g/office/computer-furniture/cabinets/orbit-side-car-cabinet 7. Network Access Control to limit what devices are allowed on the local network. That unattended RJ45 jack or poorly secured wireless environment is as much a threat as that USB port or CDROM. Bluetooth setting should also be reviewed. 8. Ensure all sensitive information traveling over the local LAN is encrypted. 9. Use a firmware password ( e.g drivelock or a BIOS power-on password) to limit who can boot the machine. 10. Monthly re-iteration of security policies – including need to lock workstations. In my experience such messages are best tied to real-world examples. It makes the risk real – not just an abstract “security guy” worry. I note that both JD and Bill talk about enhanced authentication – including the use of proximity devices. Using such devices ( mostly bluetooth ) to secure these workstations sounds like a great idea to me and may be the easiest and most effective solution. Once the financial institution walks away from the workstation – it’s locked and ideally will not boot. http://btprox.sourceforge.net/ – open source Google “computer proximity lock” for a number of commercial alternatives.

Adam Hostetler closed the conversation with:

Everyone has really good suggestions so far. I am a fan of the simple phsyical solutions. I would put the workstations in locked cages. This would prevent any malicious people from inserting USB devices or CDs, or implanting sniffers between the keyboard and USB ports. Additionally, follow the other advice of disabling them through software, just to be sure.

Another solution may be to move to a thin client solution. It is possible to buy thin clients that have no USB ports or optical drives. This would also ensure that no sensitive information was on the workstation, in the event that it was stolen.
